PLACEHOLDER — THIS DOCUMENT STATES NO TERMS AND BINDS NOBODY.
It is engineering scaffolding, seeded so that Pack & Kin Studio's versioning and acceptance machinery can be built, tested and operated before the real text exists. It has not been drafted or reviewed by a lawyer. Nothing in it is a representation, a warranty, a limitation of liability, or a grant or reservation of any right.
The reviewed text will be published as a NEW VERSION of this same document. This version will remain readable at its own permanent address so that any acceptance recorded against it can still be produced.
Platform Terms of Service
The agreement between Pack & Kin and the party that opens an account on Pack & Kin Studio — a store, a mailroom, a dealer or a developer.
Scope this document will need to cover:
- Who the parties are, and which entity contracts with which.
- What the service is, and what it is not (Pack & Kin is the store's software vendor; it is not a party to the store's own sales).
- Fees, billing, taxes, and what happens on non-payment.
- Card processing and the roles each party holds under the card network rules.
- Suspension, termination, and what happens to data on the way out (see docs/tenant-lifecycle.md for what the product actually does).
- Warranties, disclaimers, limitation of liability, indemnities.
- Governing law, venue, and dispute resolution.
- How this document may be changed, and what notice a material change carries. NOTE FOR COUNSEL: the mechanism exists — a version marked 'requires re-acceptance' re-prompts every account holder. What has to be decided is the notice PERIOD and whether continued use is sufficient assent for non-material changes.
